The presences on the social media platforms are hereinafter referred to as “social media presences”, unless expressly designated individually.
This legal notice and the data protection information only apply to our social media presences on which this text is stored or from which reference is made to this text by means of a link.

Data protection information per Art. 13 GDPR

1. Responsible for data processing:

PFALZKOM GmbH, Wredestraße 35, 67059 Ludwigshafen (hereinafter referred to as “we”) is responsible for the processing of personal data insofar as we process your data that is collected in connection with the use of our social media sites for our own purposes; how this is done is explained in detail below.

The respective providers of the social media platforms are also responsible:

Insofar as data processing in the context of the provision and use of our social media platforms is carried out on the basis of joint responsibility per Art. 26 para. 1 GDPR by us and the respective provider, such as in particular data evaluation for statistical purposes (see 2. e)), we have concluded an agreement with the provider in accordance with the legal requirements between jointly responsible parties, which you can view here:

2. Information on the processing of personal data by us

2.1 Purposes of data processing
We process your personal data, which is collected when you use our social media sites, for the following purposes:

  • Carrying out marketing campaigns and for the purpose of recruiting personnel;
  • Interaction between us and the users of our social media sites, such as direct messages, commenting, recommending or sharing content or responding to your requests or concerns;
  • Analysis of user behavior and to measure the reach of our content offered on the social media sites in order to review and improve our offers.

2.2 Subscribing to and following our social media sites
If you subscribe to or follow our social media sites, we will receive a message about this and can see you in our list of subscribers or followers. This also allows us to access your respective social media profile and thus have access to your publicly accessible personal data. Depending on the social media platform, this may be your first and last name or your username, your profile picture, your job title, your company and possibly even other contact details.

2.3 Interactions on our social media channels, such as commenting, recommending and sharing content
Our social media sites offer you the opportunity to react to our content provided there, to comment on it, to recommend it (e.g. using the “Like” or “Share” buttons) and to send us public and private messages.
Please note that your public interaction on our social media sites leads to direct personal attribution and is also visible to other users of the social media platforms.

3. Marketing and recruiting

The data mentioned under 2.2 and, if applicable, other data from your profile or data collected during your interaction with our social media presence or your use of the social media platform in general may also be processed for market research and advertising purposes. This happens, for example, when we place advertisements or job advertisements on the respective social media platforms. However, the data is processed by the respective providers. We have no influence over this. Please also note that they can create usage profiles from your usage behavior. These usage profiles can in turn be used, for example, to place advertisements and job advertisements within and outside the platforms that presumably correspond to your interests or your professional skills. Please contact the providers of the social media platforms for more information.

4. Data evaluation for statistical purposes

To statistically evaluate the use of our social media sites, we collect statistical data in aggregated form, which provides us with insights into the use of our social media sites and the interaction with the content provided there (so-called “insights data”).

Insights data includes the following information, depending on the social media platform:

  • Number of interactions (e.g. using the “Like” button, commenting or sharing posts)
  • Number of comments
  • Dwell time for video contributions
  • Visitor key figures (e.g. page views)
  • Demographic data on visitors (e.g. age, gender, location, field of activity, industry)
  • Reach (describes how many people are reached by a particular contribution)
  • Engagement rate (indicates how many people who see a piece of social media content from us react to it with likes, comments or shares)
  • First Time Impression Ratio (impressions describe the number of people who were reached with a piece of content for the first time).

We cannot use the insights data to draw any conclusions about individual persons.

5. Legal basis

If you provide us with personal data by contacting us, e.g. by e-mail, by direct message within the social media platforms or by commenting on or sharing our posts, we process your data in accordance with Art. 6 para. 1 (1 b) GDPR for the purpose of fulfilling the contract or implementing pre-contractual measures taken at your request or in accordance with Art. 6 para. 1 (1 f) GDPR due to our legitimate interest in answering your request or interacting with you within a social media platform. Processing may also be necessary in order to assert claims against you or to process your claims against us. In doing so, we process the data that you provide to us directly via your request and, if necessary for the purposes mentioned, your publicly visible data. For social media platforms, this is usually your username and photo as well as the message you send us.

Furthermore, we may be obliged to process your data for legal reasons, e.g. if you make criminal statements. The legal basis is then Art. 6 para. 1 (1 c) GDPR in conjunction with the relevant law.

The processing of the user data mentioned under (2. b to e) is carried out in accordance with Art. 6 para. 1 (1 f) GDPR on the basis of our legitimate interests in providing users with targeted information about us and our services, optimizing the design of our social media presence and communicating effectively with users. If the users are asked by the respective providers of the social media platforms for consent to data processing (e.g. when registering by ticking a checkbox or confirming a corresponding button), the legal basis for processing is this consent (Art. 6 para. 1 (1 a) GDPR).

6. Categories of recipients of data; data transfers to a third country

Service providers and vicarious agents used by us in connection with our social media presences, e.g. advertising agencies or IT service providers, may have access to the data mentioned under 2. b) to e). If these service providers and vicarious agents process data on our behalf, they act in accordance with our instructions and are contractually bound by us accordingly. The providers of the social media platforms, on the other hand, do not act in accordance with our instructions, but process your data under their own responsibility or in joint responsibility with us (see under 1.). We would like to point out that your data may also be processed by the providers of the social media platforms outside the EU and the EEA and thus also outside the applicability and protection of the EU General Data Protection Regulation (GDPR). This may result in risks for you because, for example, it could make it more difficult to enforce your rights. In order to limit this risk, we ensure that the necessary guarantees are in place for the transfer to third countries, e.g. the conclusion of standard contractual clauses within the providers of the social media platforms or certification under an adequacy decision. 7. Lead Gen Forms

7.1 Area of application
As part of our customer acquisition process, we use so-called Lead Gen Forms. Lead Gen Forms are advertising placements in social networks that enable the integration of contact forms in sponsored content. The legal basis for the use of lead ads tools is Art. 6 para. 1 (f) GDPR. Our legitimate interest in the use of these tools serves marketing purposes in the context of business initiation. We use the Lead Gen Forms services of the following providers:

  • LinkedIn (LinkedIn Lead Generation),
  • XING (Lead Ads),
  • Facebook (Lead Ads)

7.2 Purpose of Lead Gen Forms
By using these Lead Gen Forms services, we offer interested parties a function in the context of new customer acquisition with which they can provide us with their e-mail address or other user information as users of a social network.
We use this functionality to address interested parties in a more targeted manner.

7.3 Information processing with Lead Gen Forms
LinkedIn (LinkedIn Lead Generation)
LinkedIn uses forms for lead generation and functions and content of the LinkedIn service can be integrated. If you are a member of the LinkedIn platform, LinkedIn can assign access to the aforementioned content and functions to the user profiles there.

Facebook (Lead ADs)

8. Your rights as a data subject

To exercise your rights, you can contact us or the providers of the social media platforms at any time. If one office is unable to answer your request because only the other office has this information, you will be informed of this. In any case, you have the following rights with regard to each controller:

  • If personal data is processed on the basis of your consent, you have the right to withdraw your consent at any time in accordance with Art. 7 para 3 GDPR. As a result, data processing based on this consent will not be continued in the future. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
  • In accordance with Art. 15 GDPR, you have the right to request information about the personal data processed about you. In particular, you can request information about the processing purposes, the category of personal data, the categories of recipients to whom your data has been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right to lodge a complaint, the origin of your data if it was not collected by the controller, and the existence of automated decision-making including profiling and, if applicable, meaningful information about its details.
  • In accordance with Art. 16 GDPR, you have the right to demand the immediate correction of incorrect or incomplete personal data stored about you.
  • In accordance with Art. 17 GDPR, you have the right to request the deletion of your personal data stored by the respective controller, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfill a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims.
  • In accordance with Art. 18 GDPR, you have the right to demand the restriction of the processing of your personal data if the accuracy of the data is disputed by you, the processing is unlawful but you refuse to delete it and the data is no longer required by the controller, but you need it to assert, exercise or defend legal claims or you have lodged an objection to the processing in accordance with Art. 21 GDPR.
  • In accordance with Art. 20 GDPR, you have the right to receive your personal data that you have provided to the controller in a structured, commonly used and machine-readable format or to request that it be transmitted to another controller and
    if your personal data is processed on the basis of legitimate interests in accordance with Art. 6 para 1 (1 f) GDPR, you have the right to object to the processing of your personal data in accordance with Art. 21 GDPR, provided that there are reasons for this arising from your particular situation.
  • In addition, if your personal data is processed for direct marketing purposes, you have the right to object at any time to the processing of your data for such marketing, including profiling, insofar as it is related to such direct marketing, in accordance with Art. 21 para 2 GDPR.

9. Duration of storage and routine deletion

Unless otherwise stated in this privacy policy for the specific data processing, we only process and store personal data for the period of time required to achieve the purpose of processing or if this is provided for in laws or regulations to which we are subject.
If the purpose of storage no longer applies or if a legally prescribed storage period expires, the personal data will be routinely blocked or deleted in accordance with the statutory provisions.
We may also store the data and information mentioned under 2.2 outside the social media platforms. However, the above applies to the duration of storage.
